General Conditions of Sale of services and sales of articles.

Bulles de Noé represented by Madame BEC-AUVITY Justine individual company registered under SIRET No. 88306620100012 whose head office is located at 137 Boulevard Desaix 63200 Riom, offers its services to any legal or natural person. 

Animal grooming establishment within a salon. 

  • “The customer” is the natural or legal person who has reserved services or is the beneficiary of Bulles de Noé services. 
  • “The services” are the services offered and/or implemented by Bulles de Noé.
  • “The Bulles de Noé grooming salon” is the place where the services
  • “The animal” is the domestic animal for which the customer requests a service.

The purpose of this contract is to define the conditions and terms of implementation implementation of the services between Bulles de Noé and the client.

These general conditions and the special conditions prevail over all the special general conditions or any other document that the client himself may be required to present.| ||77

  1. Order.

Subscribing to a service requires acceptance by the customer of these general conditions of sale. The customer acknowledges the same fact, having read them fully, accepts them without reservation and waives his own conditions.

For any new customer and/or dog service weighing more than 30 kg, an advance of 30% of the minimum amount of the service reserved will be requested. It will be paid directly at the salon when making an appointment or on the online reservation site.

Bulle de Noé reserves the right not to follow up on an order from a customer with whom there is a dispute relating to non-payment of a service or an internal order. 

The services are provided at the Bulles de Noé grooming salon, located at 137 Boulevard Desaix 63200 Riom. The place, date and time of the appointment will be agreed by a joint agreement between the client and Bulles de Noé. 

In the event that the client or the person responsible for representing him is absent at the agreed place and time, or a delay of 15 minutes or more is noted, Bulles de Noé reserves the right not to provide services. In this case, Bulles de Noé reserves the right to charge compensation costs of 50% of the estimated grooming amount, at the next appointment. 

Appointments are made at least 24 hours in advance depending on availability, but it would be preferable to make an appointment a few weeks before the desired date, especially if the client has to go to a event with your pet (going on vacation, etc.) or during periods of high frequency. For any cancellation, you must notify at least 24 hours in advance otherwise you will be charged compensation of 50% of the estimated service. 

Bulles de Noé reserves the right to modify the organization of meetings in order to ensure the safety of the animals, the hygiene of the premises (risk of cross infections), and undertakes to notify you as quickly as possible. 

2.Services.

The services offered by Bulles de Noé are, grooming (bathing, clipping, scissor cutting and hair removal) of dogs, cats and NACs (New Pets). ), all breeds. 

All services include: bathing, drying, haircut, ear waxing, nail cutting, cleaning of eyes and ears (if necessary).

Cutting of ears nails, ear hair removal as well as eye and ear cleaning can be carried out excluding full grooming services.

The products used on the animal are specific to animals Bulles de Noé cannot be held responsible in the event of an allergy if it has not been reported before making the appointment. 

For the use of a shampoo provided by the customer, a veterinary prescription dated less than 6 months may be requested. 

Services take place on Tuesday, Wednesday, Thursday and Friday from 9:00 a.m. to 12:30 p.m. and from 1:30 p.m. to 5:00 p.m. Saturday from 8 a.m. to 12:30 p.m. (closed Sunday, Monday and public holidays). 

Beyond these hours or during closing days or public holidays, an additional charge of 50% of the grooming may be requested.

If the presence of a parasite is noted on the pet during grooming, a supplement will be requested. 

Animal grooming will be done in the grooming area separated by a barrier from the reception area. Access is prohibited to customers unless specifically authorized by Bulles de Noé. 

If grooming becomes difficult and dangerous for both the animal and the people present, Bulles de Noé reserves the right to end the grooming at any time. The customer will still have to pay the full amount for the grooming. 

In the event of a bite, Bulles de Noé can request proof of anti-rabies vaccination for the animal and request veterinary health surveillance (with veterinary surveillance certificates).

3. Price – Rates – Payment. 

The prices displayed or given by telephone conversation or email to the customer are inclusive of VAT and valid in the case of regular maintenance and compliance with the breed standard. 

For dog services, as well as the cat with bath service, the first hour is due in full then any additional quarter of an hour started will be due. For cat services without a bath, as well as NAC services, the first half hour is due then any additional quarter of an hour started will also be due.

The grooming time may vary depending on the size of the cat. the animal, its behavior, the density of its fur but also its maintenance.

A supplement may be applied for premature wear of the cutting heads in the case of an unmaintained animal (excessive knots , vegetation or other stuck in the hairs, etc).

The prices displayed are valid on the day of the order and do not affect the future. Payment for services is made immediately after the service, no payment deadline or monthly payment will be granted unless agreed by Bulles de Noé. 

Payment for services or the sale of accessories linked to the activity is made by bank check, transfer or cash. They can also be made with PASS COMMERCE checks, set up by RLV on condition of respecting the validity date of the latter. 

Payment for accessory orders is made on the day of the order. In the event that the items ordered are no longer available, the items will be refunded or credit will be offered. 

No claim will suspend payment. 

Failure to pay at the due date any amount due to Bulles de Noé gives rise to the collection of a penalty equal to 3 times the legal interest rate. These penalties will be due from the day after the due date of the unpaid sums without prior notice. 

4. Reductions – Discounts.

In the event that Bulles de Noé makes a discount (loyalty discount, etc.) the discounts will not be cumulative and Bulles de Noé reserves the right to no longer grant discounts or increase the price of the service. 

5. Security. 

The customer is asked not to enter the private parts of the establishment: rest room, office and bathroom, unless agreed by Bulles de Noé. 

For safety reasons with regard to animals which may be roaming freely in the grooming area, the customer is asked not to open the barrier separating the reception area and the grooming area, under penalty to be legally responsible in the event of an accident/runaway of an animal.

In the event that the animal is not finished when the customer arrives, they are asked not to speak to his animal, not to not show yourself exhaustively and settle calmly in the waiting area in order to leave the animal in a calm state to limit the risk of injury. 

For the safety of animals, this must be kept on a leash or in a container (bag, cage), adapted to the animal (size and/or adjustment) and in perfect condition (cage that closes, collar not broken…) and this until the animal is taken care of by Bulles de Noé as well as after return at the end of the grooming. Any accident caused by an animal or the animal running away due to non-compliance with this Bulles de Noé rule cannot be held responsible. 

6. Sale of items – Delivery. 

The products sold by Bulles de Noé are available at the show or on the show's online sales website. Products are sold while stocks last. However, an order remains possible with delays depending on the suppliers.

The items available on the salon's online sales website cannot be delivered to your home, however they can be collected from the store free of charge, an email or SMS will be sent to the customer to give a date and time to collect the order. 

The products and items sold remain the property of Bulles de Noé until full payment of their price. The risks are nevertheless borne by the buyer from the delivery of the items sold, who will therefore assume their conservation at their own expense, risk and peril.

7. Obligation of Noah's Bubbles. 

Bulles de Noé undertakes to do everything possible to ensure that the grooming of the animal is carried out in the best conditions and thus undertakes to carry out its service in accordance with the rules of the art and of the best way.

However, he cannot guarantee customers that the requests he makes in terms of cutting will give him complete satisfaction insofar as the final result depends of different factors and particularly on the nature of the animal's hair but also depending on the condition of the animal (certain stains and traces of dirt, knots stuck to the skin, etc.).

The grooming salon as well as all installations and small tools are disinfected and disinsected regularly. Hygiene rules will be observed during grooming operations (single-use towel, etc.).

Bulles de Noé reserves the right to muzzle an animal that is aggressive or to request the presence of the customer (pet owner) for aggressive dogs. Bulles de Noé also reserves the right to refuse to provide the service in the event of just cause in particular, but sense that these examples are exhaustive, due to doubt when the state of health of the animal would not allow ensure the service, if the animal shows signs of danger, as well as for exorbitant requests or contrary to the ethics of animal groomers or if this goes against the well-being animal.

Bulles de Noé reserves the right to refuse the grooming of an animal following suspicion of a contagious or infectious disease. 

Bulles de Noé undertakes in the event of symptoms occurring suddenly during grooming, requiring an emergency visit to a veterinary clinic, to take the animal to the nearest veterinarian at the customer's expense if the cause is in no way the fault of the groomer (epilepsy, heart murmur, etc.). Bulles de Noé declines all responsibility in the event of the presence of a known/unknown genetic malformation (cardiomyopathy, hip dysplasia, etc.) or other pathologies (osteoarthritis, animal heart disease, disc herniation, patellar dislocation, etc.).

Bulles de Noé undertakes on the contrary to pay veterinary costs in the event of injury during grooming, excluding sanitary shearing, and for which the responsibility of Madame BEC-AUVITY Justine or one of her employees is called into question . Payment of costs can be made through their insurance: Professional Civil Liability.

8. Customer obligation. 

The customer undertakes to entrust Madame BEC-AUVITY Justine and her employees with a healthy animal, up to date with its vaccinations, tattooed and/or chipped, he declares that he has insurance covering damages caused by his animal. 

The customer undertakes to be at the place and time of the meeting contained in the service and to pay the amount of the service immediately at the end of the service. 

The client undertakes to provide all information useful for the smooth running of the grooming, as well as possible health problems, treatment, bite history, etc.

In the In the event that the animal turns out to be very tangled and the only solution would be very short shearing, the customer undertakes to provide care to their animal in the event of sunburn, burns, etc.

The cats will be kept in a container (bag or cage). 

The customer is responsible for their animal once it has passed through the reception side of the salon Bulles de Noé will not be responsible for the consequences of delicate crossing between animals, or immediately upon opening from the front door. 

9. Disclaimer. 

In the case of the services it offers, Bulles de Noé will only be subject to a general obligation of means. Bulle de Noé therefore undertakes to do everything possible to ensure the perfect grooming of the animal entrusted to it, according to the rules of the art and in the best possible way. It is, however, expressly understood that Bulles de Noé will in no case be responsible for the deficiencies or failures of the customer in the maintenance of their animal or of a third party not authorized by Bulles de Noé. 

Similarly, the customer acknowledges being informed that certain stains or traces of dirt remain unaffected by the products and treatments and cannot be taken care of by Bulles de Noé. The customer thus acknowledges that partial shearing of the animal in total will be preferable and in such a case, Bulles de Noé cannot be responsible for the side effects caused by said shearing (cuts, itching, redness, razor burn, cold spells). , etc).

Concerning cat grooming, the customer acknowledges that he has been made aware of the various risks (cuts, state of stress, etc.) for his animal. In the event of sanitary mowing (knots stuck to the skin, etc.) Bulles de Noé cannot be held responsible for incidents and consequences linked to this mowing (cuts, burns, itching, sunburn, etc.) and will not give rise to any compensation. in charge of any veterinary costs.

The customer undertakes to always communicate the state of health of their cat, Bulles de Noé cannot be held responsible for a veterinary emergency if the owner has failed to this obligation. 

The risks linked to the use of the products are mentioned on the product, as well as, where applicable, in the product instructions. By subscribing to these general conditions, the customer declares to be fully informed of all the risks, even exceptional, relating to the use of the products by Bulles de Noé or the subject of the sale. In the event of the occurrence of an adverse effect not mentioned on the packaging or in the product instructions, the customer is invited to inform their veterinarian or the manufacturer of the said product.

In the event of a failure attributable to Bulles de Noé in the performance of its service, its liability will be limited to the direct damage caused to the customer, excluding immaterial or indirect damage such as operating loss, lucky profit after commercial loss or loss of profit.
